The jurisprudential rules result from the jurisprudence of the superior courts which are judges of law

These are mainly the Court of Cassation for the judiciary, the Council of State for the administrative order. Constitutional jurisprudence results from the decisions of the Constitutional Council .

The rules of personal , family and contract law  ; in civil liability ( contractual and tort ) and social security  ; in real estate law and construction law  are developed by the three civil chambers of the Court of Cassation. The rules concerning commercial law are the responsibility of the Commercial Chamber and that of social law of the Social Chamber. The rules of criminal law are the responsibility of the Criminal Chamber of the Court of Cassation.
