Article L121-1

The National Commission for Public Debate, an independent administrative authority, is responsible for ensuring respect for public participation in the process of developing development or equipment projects of national interest of the State, local authorities, public establishments and private individuals, falling within the categories of operations the list of which is set by decree in the Council of State, when they present strong socio-economic issues or have significant impacts on the environment or territory Development.
Public participation can take the form of a public debate. This one is about the opportunity,
Public participation is ensured throughout the development phase of a project, from the initiation of preliminary studies until the end of the public inquiry carried out in application of the provisions of Chapter III of Title II of Book I of this code or chapter I of title I of the code of expropriation for public utility.
In addition, the National Commission for Public Debate ensures that good public information conditions are respected during the implementation phase of the projects referred to it until the reception of the equipment and works.
At their request, it advises the competent authorities and any contracting authority on any question relating to consultation with the public throughout the development of a project.
The National Commission for Public Debate is also responsible for issuing all opinions and recommendations of a general or methodological nature likely to promote and develop consultation with the public.
The National Commission for Public Debate and the specific commissions do not comment on the substance of the projects submitted to them.

The provisions of this chapter are not applicable to town planning documents and to development operations provided for in Book III of the Town Planning Code. However, certain investment projects may be included, the list of which is fixed by decree in the Council of State.
When the public debate is organized under the conditions provided for in this chapter, the provisions provided for in Article L. 300-2 of the Town Planning Code do not apply.
