Section 1: Master plans for water development and management
Article L212-1
One or more master plans for water development and management establish for each basin or group of basins the fundamental orientations of a balanced management of water resources, as provided for in Article L. 211-1.
They take into account the main programs decided by the public authorities and define in a general and harmonized manner the objectives of water quantity and quality as well as the arrangements to be carried out to achieve them. They delimit the perimeter of the sub-basins corresponding to a hydrographic unit.
Programs and administrative decisions in the water sector must be compatible or made compatible with their provisions. Other administrative decisions must take into account the provisions of these master plans.
Article L212-2
The master plan (s) for water development and management are drawn up, at the initiative of the basin coordinating prefect, by the competent basin committee.
The basin committee brings together representatives of the State and of the regional and general councils concerned, who provide it with all useful information falling within their competence.
The basin committee collects the opinion of the regional councils and general councils concerned on the draft plan that it has adopted. These opinions are deemed to be favorable if they are not given within four months of the transmission of the draft master plan.
The master plan for water development and management is adopted by the basin committee and approved by the administrative authority. It is made available to the public and revised according to the forms provided for in the preceding paragraphs.
