A GOOD FAMILY’S FATHER

(paterfamilias)

(civil right)

Criterion for the objective assessment of the attitude of a subject of law for the purposes of determining whether he has breached his obligations. It is an assessment  in abstracto , that is to say independently of its own qualities and faculties, the taking into account of which would lead to a subjective assessment ( in concreto ). The good father of a family represents a moderately diligent, reasonable or wise individual.

When this standard is not respected, the act can be qualified as fault, which will involve the responsibility of the author. Depending on the importance of the deviation from the norm, the fault is slight or heavy.
