CIVIL CODE AND JURISPRUDENCE

The case law has developed whole sections of law based on a number of fundamental articles of the Civil Code.

This concerns in particular the following articles

article 9 of the Civil Code

this article is the basis for the development by case law of the protection of privacy and therefore of fundamental aspects of press law

article 1147 of the Civil Code

this article is the basis for the development by jurisprudence of the law of contractual liability , with

the distinction between obligations of means and obligations of result

development of security obligations

the development of the duty to advise and the duty to provide information

article 1382 of the Civil Code

this article is the basis for the development by jurisprudence of tort law . In this article visa jurisprudence has especially built the system of unfair competition , the abusive support , the abuse of majority   or minority or management misconduct leaders

article 1384 of the Civil Code

This article is the basis for the development by jurisprudence of the law of vicarious liability and liability for the act of things.

Articles 1382 and 1384 are thus the basis for the development of liability law.
