DIVERSION OF PLEDGE

Embezzlement is a form of fraudulent appropriation of the property of others by embezzlement which constitutes an offense bordering on breach of trust.

DIVERSION OF PLEDGE

The misappropriation of pledges is defined by article 314-5 of the penal code as the fact, by a debtor, a borrower or a third party pledging, destroying or diverting the object constituted as a pledge

Embezzlement and penalties

He is punished by three years’ imprisonment and a fine of 375,000 euros.

Attempt to embezzle pledge

The attempted embezzlement of pledge is punishable by the same penalties as the embezzlement of pledge
