The possibility for the purchaser to substitute for another purchaser, moreover by remaining guarantor of the payment of the price, is incompatible with the conclusion of a real estate sale contract, an instant contract which is realized by the agreement between the purchaser and the seller about the thing sold and the price. As the co-contracting party has not entered into any commitment and in particular not that of settling the sale price, the disputed act constitutes only a simple promise to sell. The fact for this co-contracting party to have signed the deed and to have paid, on the same day, 10% of the sale price constitutes acceptance of the promise to sell. The act is void if it has not been registered within ten days.
