STOP OF SOCIETE DES GRANITS PORPHYROIDES DES VOSGES
IN THE NAME OF THE FRENCH PEOPLE
Having regard to the summary request and the amplifying memorandum presented for the company of Granits porphyroïdes des Vosges whose head office is in Paris 4 rue de Castillane, represented by its director and directors in office, the said request and the said memorandum registered with the Council’s Litigation Secretariat of State on January 22 and March 11, 1908 and tending that the Council should annul a decision of November 20, 1907 and as necessary a previous decision of June 1 of the same year, by which the mayor of the city of Lille has applied to the exhibiting company the penalties provided for, in the event of delay in deliveries, to the contract between the company and the city of Lille for the supply of paving stones; Considering the law of April 5, 1884;
Considering that the claim of the Société des granits porphyroïdes des Vosges tends to obtain the payment of a sum of 3,436 francs 20, which was retained as a penalty by the city of Lille, on the amount of the price of a supply of paving stones, due to delays in deliveries;
Considering that the contract passed between the city and the company, was exclusive of all works to be carried out by the company and had for sole object the supplies to be delivered according to the rules and conditions of the contracts intervened between individuals; that thus said request raises a dispute which it does not belong to the administrative jurisdiction to know; that, consequently, the request of the company is not receivable;
DECIDES: article 1: The above-mentioned request of the Société des Granits porphyroïdes des Vosges is rejected. Article 2: The costs are borne by the Société des Granits porphyroïdes des Vosges. Article 3: Dispatch of this decision will be sent to the Minister of the Interior.
