CLASSIFICATION OF PRIVILEGES

Section 3: Classification of privileges

Article 2332-1

Unless otherwise specified, special privileges take precedence over general privileges .

The general privileges are exercised in the order of article 2331, with the exception of the privilege of the Public Treasury, the rank of which is determined by the laws which concern it, and the privilege of the social security funds, which comes to the same rank as the privilege of employees.

The special privileges of the lessor of a building, the curator and the seller of furniture are exercised in the following order:
1 ° The privilege of the curator, when the costs of conservation are subsequent to the birth of the other privileges;
2 ° The privilege of the lessor of the building, who was unaware of the existence of the other privileges;
3 ° The custodian’s privilege, when the custody costs are prior to the birth of the other privileges;
4 ° The privilege of the seller of furniture;
5 ° The privilege of the lessor of the building, who was aware of the existence of the other privileges.
Among the curators of the same piece of furniture, preference is given to the most recent. Between sellers of the same piece of furniture, it is given to the oldest.
For the application of the above rules, the privilege of the hotelier is assimilated to the privilege of the lessor of the building; the privilege of the salaried auxiliary of a home worker is the privilege of the seller of furniture.
