Article L121-16
(Ordinance n ° 2001-741 of August 23, 2001 art. 5 and art. 7 Official Journal of August 25, 2001)

The provisions of this section apply to any sale of a good or any provision of a service provision concluded, without the simultaneous physical presence of the parties, between a consumer and a professional who, for the conclusion of this contract, exclusively use one or more remote communication techniques.

Article L121-17

The following contracts are not subject to the provisions of this section:
1 ° relating to financial services;
2 ° Concluded by means of automatic vending machines or for services provided in automated commercial premises;
3 ° Concluded with telecommunications operators for the use of public telephone booths;
4 ° Concluded for the construction and sale of immovable property or relating to other rights relating to immovable property, with the exception of rental;
5 ° Concluded at a public auction.
