PLEDGE RELATING TO A MOTOR VEHICLE

Section 2: Pledge on a motor vehicle

Article 2351

(inserted by Ordinance n ° 2006-346 of March 23, 2006 art. 11 Official Journal of March 24, 2006 in force on July 1, 2008 at the latest)

When it relates to a land motor vehicle or a registered trailer, the pledge is enforceable against third parties by the declaration which is made to the administrative authority under the conditions set by decree of the Council of State.

NOTE: Ordinance 2006-346 of 23 March 2006 art. 58: Article 2351 in its wording resulting from article 11 of ordinance 2006-346 will come into force on a date which will be fixed by decree and which cannot be later than July 1, 2008.

Article 2352

   By issuing the receipt of the declaration, the pledgee will be deemed to have kept the pledged property in his possession.
   NOTE: Ordinance 2006-346 of 23 March 2006 art. 58: Article 2352 in its wording resulting from article 11 of ordinance 2006-346 will come into force on a date which will be fixed by decree and which cannot be later than July 1, 2008.

Article 2353

The realization of the pledge is subject, whatever the capacity of the debtor, to the rules provided for in articles 2346 to 2348.
