ABUSE OF AUTHORITY DIRECTED AGAINST THE ADMINISTRATION

Article 432-1

The fact, by a person holding public authority, acting in the exercise of his functions, to take measures intended to thwart the execution of the law is punishable by five years of imprisonment and 75,000 euros d. ‘fine.

The offense provided for in article 432-1 is punishable by ten years’ imprisonment and a fine of 150,000 euros if it has been followed up.

The fact, by a person holding public authority or entrusted with a public service mission or by a person invested with a public elective mandate, having been officially informed of the decision or of the circumstance terminating his functions, to continue to exercise them, is punished by two years’ imprisonment and a fine of 30,000 euros.
