Section 7: Additional penalties applicable to natural persons.

Article 223-16

Natural persons guilty of one of the offenses provided for in articles 223-3 to 223-8, 223-10 to 223-14 also incur the prohibition of civic, civil and family rights, in accordance with the procedures provided for by the article 131-26.

Article 223-17

Natural persons guilty of one of the offenses provided for in Articles 223-3, 223-4, 223-8, 223-10 to 223-14 also incur the following penalties:

1 ° Prohibition, in accordance with the procedures provided for in article 131-27 , either from exercising a public function or from exercising professional or social activity in the exercise or on the occasion of the exercise of which the offense was committed, either, for the crime provided for in article 223-4, to exercise a commercial or industrial profession, to direct, administer, manage or control in any capacity, directly or indirectly , for its own account or for the account of others, a commercial or industrial enterprise or a commercial company. These exercise bans may be pronounced cumulatively;

2 ° Confiscation defined in article 131-21; in the cases provided for in articles 223-13 and 223-14, the written, visual or audio documents used to carry out the offense may be seized or confiscated; the court may also order the destruction, in whole or in part, of these documents;

3 ° The permanent closure or for a period of five years at most of one, several or all of the establishments of the company which were used to commit the offense.

In the case provided for by article 223-8, the exclusion of public contracts may also be pronounced definitively or for a period of five years at most.

Article 223-18

Natural persons guilty of the offense provided for in article 223-1 also incur the following penalties:

1 ° Prohibition, in accordance with the procedures provided for in article 131-27, from exercising professional or social activity in the exercise of or on the occasion of the exercise of which the offense was committed;

2 ° The prohibition, for a period of five years at most, to hold or carry a weapon subject to authorization;

3 ° The suspension, for a period of five years at most, of the driving license, this suspension being able to be limited to the driving outside the professional activity; if the offense was committed while driving a land motor vehicle, the suspension cannot be accompanied by the suspension, even partially, and cannot be limited to driving outside the professional activity ;

4 ° Cancellation of the driving license, with a ban on requesting the issue of a new license for a maximum of five years;

4 ° bis The obligation to complete an awareness training course on the dangers of the use of narcotic products, in accordance with the terms set out in article 131-35-1;

4 ° ter The obligation to complete a parental responsibility training period, in accordance with the terms set out in article 131-35-1;

5 ° When the offense was committed while driving a land motor vehicle, the ban on driving certain land motor vehicles, including those for which the driving license is not required, for a maximum of five years;

6 ° When the offense was committed while driving a land motor vehicle, the obligation to complete, at their own expense, a road safety awareness course;

7 ° When the offense was committed while driving a land motor vehicle, the immobilization, for a period of one year at most, of the vehicle which the convicted person used to commit the offense. offense, if he is the owner;

8 ° When the offense was committed while driving a land motor vehicle, the confiscation of the vehicle which the convicted person used to commit the offense, if he is the owner.

Article 223-19

Natural persons guilty of one of the offenses provided for in articles 223-10 and 223-11 incur, in addition to the penalties mentioned by these articles, a ban, for a period of five years at most, from exercising an activity of medical or para-medical nature.

Article 223-20 .

Natural persons guilty of one of the offenses provided for by articles 223-1 and 223-8 also incur the additional penalty of posting or disseminating the decision provided for by article 131-35.
