Article L147-1

In all commercial establishments where the practice of tipping exists, all the collections made “for the service” by any employer in the form of a percentage compulsorily added to the notes of the customers or otherwise, as well as all sums remitted voluntarily by the customers for the service between the employer’s hands, or centralized by him, must be entirely transferred to the staff in contact with the customers and to whom the latter used to hand them directly.

NOTE: Ordinance 2007-329 2007-03-12 art. 14: The provisions of this ordinance come into force at the same time as the regulatory part of the new labor code and no later than March 1, 2008.

The sums mentioned in the previous article must not be confused with the fixed salary or be substituted for it, except in the case where a minimum salary has been guaranteed by the employer.
