(Regulatory Part – Decrees of the Council of State)

 

Chapter I: Motorways

Article R421-1

   The provisions relating to traffic on motorways are also applicable to motorway connecting ramps.

Article R421-2

   I. – Access to highways is prohibited to traffic:
1 ° Animals;
2º Pedestrians;
3 ° Vehicles without an engine;
4 ° Motor vehicles not subject to registration;
5º Mopeds;
6 ° Motor tricycles the power of which does not exceed 15 kilowatts and the unladen weight of which does not exceed 550 kilograms;
7º Motorized quadricycles;
8º Tractors and agricultural equipment and public works equipment. However, on motorways, the circulation of public works equipment may be permitted with the authorization of the prefect or, by delegation, of the departmental director of equipment;
9 ° Combinations of vehicles comprising several trailers and combinations of vehicles comprising an articulated vehicle and a trailer, the circulation of which is subject to authorization by the prefect in application of article R. 433-8.
II. – The fact for any pedestrian to circulate on a freeway is punished with the fine envisaged for the tickets of the first class.
III. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the second class.

Article R421-3

   Any driver who takes a motorway junction must give way to vehicles traveling on the motorway.
Failure to comply with the priority rules set out in this article for any driver is punishable by the fine provided for fourth class contraventions.
Any driver guilty of this offense also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity.
This contravention automatically gives rise to a reduction of four points of the driving license.


Article R421-4

   I. – As soon as, on the motorway, an exit ramp or a fork is announced, all drivers must, as the case may be:
1 ° Go to the right or left traffic lane if they wish to take the exit ramp;
2 ° Go to the lane or one of the traffic lanes corresponding to the motorway branch in which he wishes to enter at the junction.
II. – Both of these maneuvers must be completed at the latest when the driver reaches the signals placed at the start of the slip road or fork.
III. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the second class.

Article R421-5

Drivers must under no circumstances drive, stop or park on the central strip separating the carriageways.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
Any driver guilty of this offense also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
This fine gives rise as of right to a reduction of two points of the driving license.
When the driver or the holder of the registration certificate is absent or refuses, despite the injunction of the agents, to put an end to the irregular parking, the immobilization and impoundment may be prescribed under the conditions provided for in Articles L. 325 -1 to L. 325-3.

NOTE: Decree 2003-293 art. 8: The provisions of articles 2, 3, 4, 6 and 7 are applicable to Mayotte.

Article R421-6

   Drivers must not under any circumstances turn around on a motorway, even when crossing the central strip separating the roadways or taking an interruption thereof. Likewise, they must not go back.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
Any driver guilty of one of these offenses also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity.
These fines give rise as of right to a reduction of four points of the driving license.

Article R421-7

   Unless absolutely necessary, drivers must not stop or park their vehicle on the roadways and shoulders, including on the emergency lanes of motorways.
Any driver finding himself in the absolute necessity of immobilizing his vehicle must do so outside the lanes reserved for traffic and in all cases ensure the advance signaling of this vehicle. If he is unable to restart it on his own, he must do what is necessary to ensure that the highway is cleared as a matter of urgency.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the second class.
When the driver or the holder of the registration certificate is absent or refuses, despite the injunction of the agents, to put an end to the irregular parking, the immobilization and impoundment may be prescribed under the conditions provided for in Articles L. 325 -1 to L. 325-3.

 

Article R421-8

   Motor vehicle or chassis testing, races, events or sports competitions are prohibited on highways.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the second class.


Article R421-9

   Any user of a motorway regularly subject to tolls must, if he is not provided with a special authorization, pay the amount of the authorized toll corresponding to the route and the category of the vehicle he uses.
The fact, for any driver, of refusing to pay the amount of the toll or of evading in any way this payment is punished by the fine provided for the contraventions of the second class.
