Chapter 3: Behavior in the event of a roadside check

Article L233-1

(Ordinance n ° 2000-916 of September 19, 2000 art. 3 Official Journal of September 22, 2000 in force on January 1, 2002)

I. – The fact for any driver of failing to obey a summons to stop emanating from an official or agent charged to note the infringements and provided with external and visible badges of his capacity is punished by three months of imprisonment and a fine of 3,750 euros.
II. – Anyone guilty of this offense also incurs the following additional penalties:
1 ° Suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity;
2 ° The sentence of community service according to the terms provided for in article 131-8 of the penal code and according to the conditions provided for in articles 131-22 to 131-24 of the same code and in article 20-5 of the ordinance nº 45-174 of February 2, 1945 relating to delinquent children;
3 ° The penalty of days-fine under the conditions set out in articles 131-5 and 131-25 of the penal code.
III. – This offense automatically gives rise to a reduction of half of the initial number of points of the driving license.

I. – Any driver refusing to submit to any prescribed checks concerning his vehicle or person is punished by three months’ imprisonment and a fine of 3,750 euros.
II. – Anyone guilty of this offense also incurs the following additional penalties:
1 ° Suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity;
2 ° The sentence of community service according to the terms provided for in article 131-8 of the penal code and according to the conditions provided for in articles 131-22 to 131-24 of the same code and in article 20-5 of the ordinance nº 45-174 of February 2, 1945 relating to delinquent children;
3 ° The penalty of days-fine, under the conditions set out in articles 131-5 and 131-25 of the penal code.
