OFFENSES AGAINST PUBLIC THINGS

Paragraph 2: Offenses against the public good.

Article 26

Modified by Ordinance 2000-916 2000-09-19 art. 3 JORF September 22, 2000 in force January 1, 2002.

Offense against the President of the Republic by one of the means set out in article 23 is punishable by a fine of 45,000 euros.

The penalties provided for in the preceding paragraph are applicable to the offense of the person who exercises all or part of the prerogatives of the President of the Republic.

Article 27

The publication, distribution or reproduction, by any means whatsoever, of false news, of fabricated, falsified or deceptively attributed to third parties when, done in bad faith, it will have disturbed the public peace, or will have been liable to disturb her, will be punished with a fine of 45,000 euros.

The same facts will be punished with a fine of 135,000 euros, when the publication, distribution or reproduction made in bad faith is likely to shake the discipline or the morale of the armies or to hinder the nation’s war effort.
