Section 2: Exceeding
Article R414-4

(Decree n ° 2003-293 of March 31, 2003 art. 2 V Official Journal of April 1, 2003)

   I. – Before overtaking, all drivers must ensure that they can do so without danger.
   II. – He can only undertake to overtake a vehicle if:
   1 ° He has the possibility of resuming his place in the normal flow of traffic without obstructing it;
   2 ° The relative speed of the two vehicles will make it possible to overtake in a sufficiently short time.
   3º He is not himself on the verge of being overtaken.
   III. – He must, in addition, if necessary, warn the user he wants to pass of his intention.
   IV. – To pass, he must move far enough so as not to run the risk of hitting the user he wants to pass. In any case, it must not approach it laterally to less than one meter in built-up areas and one and a half meters outside built-up areas in the case of an animal-drawn vehicle, a two-person or two-person machine. with three wheels, a pedestrian, a rider or an animal.
   V. – The fact, for any driver, of contravening the provisions of II to IV above is punished by the fine provided for contraventions of the fourth class.
   VI. – Any driver who contravenes the provisions of II to IV above also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   VII. – This fine gives rise as of right to a reduction of three points of the driving license.

   NOTE: Decree 2003-293 art. 8: The provisions of articles 2, 3, 4, 6 and 7 are applicable to Mayotte.

Article R414-5

   When approaching crossings intended for pedestrians, drivers should only pass after making sure that no pedestrian is engaged in the crossing.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

Article R414-6

(Decree n ° 2003-293 of March 31, 2003 art. 2 VI Official Journal of April 1, 2003)

   I. – Overtaking is carried out on the left.
   II. – As an exception to this rule, any driver must pass on the right:
   1 ° A vehicle whose driver has indicated that he is preparing to change direction to the left;
   2 ° A vehicle traveling on a railway track using the roadway when the gap between this vehicle and the edge of the roadway is sufficient; however, in the latter case, the overtaking may take place on the left on roads where traffic is one-way or on other roads when the overtaking leaves the entire left half of the road free.
   III. – The fact, for any driver, of contravening the provisions of this article is punished by the
   IV. – Any driver guilty of the offense provided for in this article also incurs the additional penalty of suspension of the driving license, for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   V. – The fact of contravening the provisions of this article automatically gives rise to a reduction of three points of the driving license.

Article R414-7

   Any driver who overtakes on the left may only enter the left half of the road if he does not obstruct oncoming traffic.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
   Any driver guilty of this offense also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   This fine gives rise as of right to a reduction of three points of the driving license.

Article R414-8

   When a two-way carriageway has more than two lanes, materialized or not, drivers overtaking must not take the lane which they think is furthest to the left.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
   Any driver guilty of this offense also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   This fine gives rise as of right to a reduction of three points of the driving license.

Article R414-9

   In all cases where the insufficiency of the free width of the roadway, its profile or its condition does not allow overtaking easily and safely, any driver of vehicles whose size or load exceeds 2 meters in width or 7 meters in length, trailer included, with the exception of public transport vehicles in built-up areas, must reduce its speed and, if necessary, stop or park to allow the passage of vehicles of smaller dimensions.
   In the same cases, all users must reduce their speed and, if necessary, stop or park to facilitate the passage of a vehicle of general interest using the special warning devices authorized for their category.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

Article R414-10

   Any driver who has just passed on the left must return to his right without slowing down the vehicle being passed.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
   Any driver guilty of this offense also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   This fine gives rise as of right to a reduction of three points of the driving license.

Article R414-11

   Overtaking is prohibited on carriageways with two directions of traffic, when the forward visibility is not sufficient, which may be the case in particular in a bend or at the top of a hill, unless this maneuver leaves free the part of the roadway situated to the left of a continuous line or if, in the case of overtaking a two-wheeled vehicle, this maneuver leaves the left half of the road free.
   Any overtaking other than that of two-wheeled vehicles is prohibited at road intersections, except for drivers approaching an intersection where drivers traveling on other roads must allow them passage in application of articles R. 415-6, R. 415 -7 and R. 415-8, or when they approach an intersection whose crossing is regulated by traffic lights or by a traffic officer.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
   Any driver guilty of one of the offenses provided for in this article also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside professional activity.
   This fine gives rise as of right to a reduction of three points of the driving license.

Article R414-12

   Any overtaking is prohibited at the crossing of railway tracks not equipped with barriers or half-barriers.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

Article R414-13

   It is forbidden for any driver to pass a stationary train or tram during the ascent or descent of passengers on the side where it is carried out.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

Article R414-14

   The fact for any driver to overtake prohibited by decision of the authority invested with police power is punishable by the fine provided for contraventions of the fourth class.

Article R414-15

   When, on one-way roads and on roads with more than two lanes, the traffic has, due to its density, established itself in an uninterrupted file on all the lanes, the fact that the vehicles of one lane circulate more faster than vehicles in another line is not considered to be overtaking.

Article R414-16

   When about to be passed, drivers should immediately pull to their right without accelerating.
   The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.
   Any driver who accelerates the pace when he is about to be passed also incurs the additional penalty of suspension of the driving license for a period of three years at most, this suspension being able to be limited to driving outside of professional activity.
   In the latter case, the contravention automatically gives rise to a reduction of two points of the driving license.

Article R414-17

   When, on the roadway, at least one traffic lane is covered with snow or ice on all or part of its surface:
   I. – 1 ° Overtaking or changing lanes is prohibited for any driver of a vehicle whose weight total authorized load exceeds 3.5 tonnes or to any driver of a combination of vehicles the length of which exceeds 7 meters;
   2 ° Overtaking winter service vehicles in action on the roadway is prohibited for any vehicle.
   II. – The fact of contravening I of this article is punished by the fine provided for contraventions of the fourth class.
   III. – Anyone guilty of this offense also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity.
