Section 2: Lighting and signaling at night, or during the day with insufficient visibility

Article R416-4

   At night, or during the day when visibility is insufficient, any driver of a vehicle must, under the conditions defined in this section, use the lights with which the vehicle must be equipped in application of the provisions of Book III.

Article R416-5

   Redlights.
Unless otherwise provided for in this code, motor vehicles must travel with the main beam (s) on.
When stationary or parked, the use of main beam headlights is prohibited.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

 

Article R416-6

   Headlights.
I. – Mopeds and light motorized quadricycles must travel with the dipped headlight (s) on.
II. – Other motor vehicles must travel with the dipped beam (s) on, with the exception of the main beam:
1 ° When the vehicle risks dazzling other users:
a) When it is about to pass another vehicle;
b) When following another vehicle at a short distance, except during an overtaking maneuver;
2 ° When the vehicle is traveling in built-up areas on a sufficiently lit road and outside built-up areas on a continuously lit road provided that this lighting is such that it allows the driver to see clearly at a sufficient distance;
3 ° When visibility is reduced due to atmospheric circumstances. However, in built-up areas, even in rainy weather, this provision does not apply to motor vehicles other than motorcycles which travel with at least their sidelamps on, when the roadway is sufficiently lit and this lighting allows the driver to see clearly at a sufficient distance.
III. – Substitution of dipped beam headlights for main beam headlights must be done sufficiently in advance so as not to hinder the progress of other users.
IV. – When the main beam headlamps are used, the dipped beam headlamps may be used simultaneously.
V. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for contraventions of the fourth class.

 

Article R416-7

   Fog lights.
I. – In the event of fog, snowfall or heavy rain, the front fog lights can replace or supplement the dipped beam headlights. They can supplement high beams outside built-up areas, on narrow and winding roads, except in cases where, in order not to dazzle other users, the low beam must replace the high beam.
II. – The rear fog light (s) may only be used in fog or snowfall.
III. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for contraventions of the fourth class.

 

Article R416-8

   Sidelights.
I. – The sidelamps can be switched on at the same time as the main beam or low beam.
II. – They must be on:
1 ° At the same time as the dipped beam headlights if no point of their illuminating surface is less than 400 mm from the end of the overall width of the vehicle;
2 ° In all cases, at the same time as the fog lights.
III. – The circulation of motorcycles with the front or their only position lights on is prohibited.
IV. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for contraventions of the fourth class.

 

Article R416-9

   I. – Motor vehicles and combinations of vehicles must travel with:
1 ° The red rear lights on;
2 ° The rear registration plate light (s) on;
3 ° The clearance lights on;
4 ° The trailer position lights on.
II. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for contraventions of the fourth class.

Article R416-10

   Bicycles and their trailers must travel with the position light and the red rear light on.
The fact, for any driver, of contravening the provisions of this article is punishable by the fine provided for first class contraventions.

Article R416-11

   The fact, for any driver of a motor vehicle, to circulate at night, or during the day when visibility is insufficient, without lighting or signaling in a place without public lighting, is punishable by the fine provided for fines. of the fourth class.
Any driver guilty of this offense also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity.
This contravention automatically gives rise to a reduction of four points of the driving license.

Article R416-12

I. – On a roadway with or without public lighting, motor vehicles and combinations of vehicles must be stationary or parked with:
1 ° At the front, the position light (s) on;
2 ° At the rear, the red light (s) and the rear registration plate light (s) on.
II. – The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for contraventions of the fourth class.
III. – At night, or during the day when visibility is insufficient, in the event of a motor vehicle stopping or parking on the roadway without lighting or signaling, in a place without public lighting, the driver also incurs the penalty. additional driver’s license suspension for a maximum of three years, this suspension may be limited to driving outside of professional activity.
IV. – In the case provided for in III, the contravention automatically gives rise to a reduction of three points of the driving license.

NOTE: Decree 2003-293 art. 8: The provisions of articles 2, 3, 4, 6 and 7 are applicable to Mayotte.

 

 

Article R416-13

   In built-up areas, motor vehicles, not coupled to a trailer, the length of which does not exceed 6 meters and the width of 2 meters must be stopped or parked with at least one parking light on white, yellow or orange towards the side. ‘front and red, yellow or orange towards the rear, placed on the side of the vehicle opposite the edge of the roadway along which it is parked.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

 

Article R416-14

   Trailers not coupled when stationary or parked on the roadway must be indicated either by the lights provided for in article R. 416-12 or by a white light at the front and a red light at the rear placed l ‘one and the other on the side of the vehicle opposite the edge of the roadway along which this trailer is parked.
If the length of the trailer does not exceed 6 meters, the two lights can be combined into a single device.
The fact, for any driver, of contravening the provisions of this article is punished by the fine provided for the contraventions of the fourth class.

 

Article R416-15

   When stationary or parked, two-wheel motorcycles without a sidecar not equipped with a battery, two-wheel mopeds and two-wheel cycles may not be reported if they are not coupled to a trailer, but they must be parked at the edge of the road.

 

Article R416-16

   In built-up areas, any stationary or parked vehicle may not be signaled when the lighting of the roadway allows other users to see it clearly at a sufficient distance.
