Section 1: Maximum authorized speeds

Article R413-1

   When they are more restrictive, the maximum speeds decreed by the authority vested with police power prevail over those authorized by this code.

Article R413-2

   I. – Outside built-up areas, vehicle speed is limited to:
1º 130 km / h on highways;
(2) 110 km / h on two-carriageway roads separated by a central reservation;
3º 90 km / h on other roads.
II. – In the event of rain or other precipitation, these maximum speeds are lowered to:
1º 110 km / h on sections of motorways where the normal limit is 130 km / h;
(2) 100 km / h on the sections of highways where this limit is lower as well as on two-carriageway roads separated by a central reservation;
3º 80 km / h on other roads.

Article R413-3

   In built-up areas, vehicle speed is limited to 50 km / h.
However, this limit may be raised to 70 km / h on road sections where local residents’ access and pedestrian crossings are limited and are protected by appropriate devices. For busy roads, the decision is taken by order of the prefect, after consultation with the mayor (s) of the municipalities concerned and that of the president of the general council in the case of a departmental road, of the president of the executive council of Corsica, if it is a road provided for in article L. 4424-30 of the general code of local authorities. In other cases, it is taken by the mayor under the same conditions.
On the Paris ring road, this limit is set at 80 km / h.

Article R413-4

   In the event of visibility less than 50 meters, maximum speeds are lowered to 50 km / h on all road and motorway networks.

Article R413-5

   I. – Student drivers and drivers who have held a driving license for less than two years are required not to exceed the following maximum speeds:
1º 110 km / h on sections of motorways where the normal limit is 130 km / h h;
(2) 100 km / h on sections of highways where this limit is lower, as well as on two-carriageway roads separated by a central reservation;
3º 80 km / h on other roads.
II. – The two-year period runs from the date of issue of the driving license, regardless of the category for which it was obtained.
III. – Any driver mentioned in this article must, while in circulation, affix visibly, at the rear of his vehicle, a distinctive sign, the conditions of use and the model of which are fixed by order of the Minister of the Interior and the Minister in charge of transport.
IV. – Failure for any driver to comply with the signaling obligation imposed by this article and the measures taken for its application is punishable by the fine provided for second class contraventions.

Article R413-6

   The provisions of article R. 413-5 are not applicable:
1 ° To drivers who have obtained, after cancellation or loss of validity, a new driving license without undergoing the practical test;
2 ° To the drivers of military vehicles;
3 ° To the drivers of vehicles of the civil security instruction and intervention units;
4 ° To the drivers of vehicles of the civil security formations set up within the framework of the provisions of the ordinance n ° 59-147 of January 7, 1959 relating to the general organization of the defense.

Article R413-7

   The speed of vehicles with a permissible total laden weight less than or equal to 3.5 tonnes and of public transport vehicles fitted with tires with protruding non-slip studs is limited to 90 km / h.
In circulation, the drivers of these vehicles must affix, in a visible manner, at the rear of their vehicle, on the lower left-hand side, a disc, the conditions of use and the model of which are fixed by order of the Minister in charge of transport.
Failure for any driver to comply with the reporting obligation imposed by this article and the provisions made for its application is punishable by the fine provided for second class contraventions.
The Minister in charge of transport fixes by decree the conditions of use of the non-slip crampons of the other vehicles.

Article R413-8

   The speed of vehicles whose authorized gross weight or authorized total rolling weight is greater than 3.5 tonnes, with the exception of public transport vehicles, is limited to:
1º 110 km / h for vehicles with total weight is less than or equal to 12 tonnes and 90 km / h for those with a total weight greater than 12 tonnes, on highways;
2º 80 km / h on priority roads marked as such. However, this maximum speed is raised to 100 km / h for vehicles whose total weight is less than or equal to 12 tonnes on roads with two carriageways separated by a central reservation;
3º 80 km / h on other roads. However, this maximum speed is lowered to 60 km / h for articulated vehicles or vehicles with trailers whose total weight is greater than 12 tonnes.
4º 50 km / h in built-up areas. However, this maximum speed is raised to 80 km / h on the Paris ring road.

Article R413-9

 The speed of vehicles transporting dangerous materials, the authorized total weight of which or the authorized total rolling weight is greater than 12 tonnes, as well as that of vehicles traveling under cover of an exceptional transport authorization, is limited to:
1º 80 km / h on highways;
2º 60 km / h on other roads. However, this maximum speed is raised to 70 km / h on priority roads and marked as such, for vehicles with specific characteristics defined by order of the Minister in charge of transport;
3º 50 km / h in built-up areas. However, this maximum speed is raised to 80 km / h on the Paris ring road.

Article R413-10

   Outside built-up areas, the speed of public transport vehicles, the total weight of which exceeds 10 tonnes, is limited to 90 km / h. However, this maximum speed is raised to 100 km / h on motorways for vehicles with specific technical characteristics defined by order of the Minister responsible for transport.

Article R413-11

   When the weight and dimensions of a winter service vehicle exceed the limits set in Chapter II of Title I of Book III, its speed is limited to 50 km / h.

Article R413-12

   The speed of vehicles and public works equipment is limited on the road to 25 km / h. The same applies to the speed of vehicles towing an agricultural vehicle or public works equipment.
However, for public works equipment assigned to pavement snow removal operations, the speed limit is increased to 50 km / h.

Article R413-13

   Vehicles whose speed is regulated by reason of their weight must bear, visible at the rear, an indication of the maximum speed (s) which they are required not to exceed.
The Minister in charge of transport fixes by decree the conditions of application of this article.
Failure for any driver to comply with the reporting obligation imposed by this article and the provisions made for its application is punishable by the fine provided for second class contraventions.

Article R413-14

(Decree n ° 2003-293 of March 31, 2003 art. 2 IV Official Journal of April 1, 2003)
   I. – The fact, for any driver of a motor vehicle, to contravene the provisions relating to the maximum speeds fixed by this code or decreed by the authority invested with the police power is punished by the fine provided for the contraventions of the fifth class, in the event of exceeding the maximum authorized speed of 50 km / h or more, and of the fourth class, in other cases.
II. – Anyone guilty of the offense of exceeding the maximum authorized speed of 30 km / h or more also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside of professional activity.
III. – Any contravention provided for in this article automatically gives rise to a reduction in the number of points of the driving license under the following conditions:
1 ° For any driver, in the event of exceeding the maximum authorized speed of 40 km / h or more, reduction of four points;
2 ° For any driver, with the exception of those who have held a driving license for less than two years, in the event of exceeding the maximum authorized speed:
a) Between 30 km / h and less than 40 km / h, reduction of three points,
b) Between 20 km / h and less than 30 km / h, reduction of two points,
c) Less than 20 km / h, reduction of one point;
3 ° For any driver who has held a driving license for less than two years, in the event of exceeding the maximum authorized speed of less than 40 km / h, reduction of three points.
   NOTE: Decree 2003-293 art. 8: The provisions of articles 2, 3, 4, 6 and 7 are applicable to Mayotte.

Article R413-15

   The fact of offering for sale, selling, holding, using, adapting, placing, applying or transporting, for any reason whatsoever, an apparatus, device or product intended either to detect the presence or to disrupt the operation of instruments used for the observation of infringements of the legislation or the regulations of road traffic is punished by the fine provided for contraventions of the fifth class.
This device, device or product is seized and confiscated.
In addition, when the apparatus, device or product is placed, fitted or applied to a vehicle, it may be seized and confiscated.
Anyone guilty of the offense provided for in this article also incurs the additional penalty of suspension, for a period of three years at most, of the driving license, this suspension being able to be limited to driving outside professional activity.

Article R413-16

   The fact for any driver of a vehicle other than a motor vehicle to contravene the provisions of this code relating to the maximum authorized speed is punished by the fine provided for the contraventions of the second class.
